Got to say I've never thought to use it that way - I will put things on our site as Exclusive but as I say purely to act more as a call to action to the punter than to deter other affiliates.

I doubt it to be honest - like I say look at the 'real world' example of newspapers - I've never seen them be brought to book by claiming a story is exclusive when it isn't
