    It is unfortunately the case that being an affiliate is 50% like a game because for the most part its done remotely and doesn't involve any personal selling.

    If it was offline, then a lot of 'grey area' affiliates would never have succeeded because if they were 'tricky' as they were growing they would never have gained the power to force others to do business with them - word would have got around early on and they would never have got any traction.

    Online, if you get to the top of Google and you've got that many customers coming to you, you can dictate terms to a large extent. Its a bit like discovering oil. Once you've got it, you'll get customers regardless.

    Until the majority of merchants know enough to make informed decisions of course... and get enough time with the directors to explain why they are doing what they are doing.

    I've been in a position to try to explain it to several very capable high flyers and you can see their eyes start to glaze over within 10 minutes or so. If you're faced with that, or just reporting the apparent success of the affiliate program, then quite justifiably many affiliate managers will no doubt take the second option. Who wants to go to the board and say 'hey, we've got a bit of a problem with the program...'

    I'm not really sure to the extent of this bloke's crimes but appears to me one of the scenarios is that an marketeer does all the promotional ground work only to see the customer trot off to MVC to make the purchase at a discount the marketeer can't offer?

    Is the answer not to promote merchants that offer voucher codes?

    Sort of.
    If he displayed the codes without forcing a click then he wouldn't cookie-nap us.

    I believe the solution lies in cookie setting when stuff gets put into the basket.
    If another site adds extra items after I've got someone to put stuff in the basket then the commission could be split according to the value of who got what in the basket.

    It's desperately unfair on content sites that do lots of pre-sell and up-sell, as well as on those other sites who do offer a voucher but havent got such a big discount like you say.

    It's also unfair when sites pretend to have a mega discount offer - get the cookie and the the discount isn't actually what they said. The article in the press this week touched on this.

    After all how ethical would it be to claim you've got a 50% discount voucher for a shop, set a cookie and for the customer to then only find a 5% discount?

    -To most people nothing when it comes to searching the internet and finding stuff.

    But in the 'industry' you have to be pedantic about the wording of your ads.

    The first states that there is a discount for 40% off Find me a gift - which is wrong

    The second states that on the website in question you could get upto 65% off an un-named company thats somewhere on the site - which is vaguely right. - oh and its updated daily

    That would be why the url references findmeagift - I must just be thick in thinking that this was alluding to upto 65% off at findmeagift given that I had searched for findmeagift - just shows how stupid I am and not having a clue about what constitutes misleading and false advertising. I could have sworn that there was some consumer protection legislation that I have used several times to talk to different company's local Trading Standards departments especially on Mondays.
