    A well known company have launched a new idea and have not secured their website.

    They have gained their trademark in September.

    Question is, should I reg the name and make a few quid from it?

    If I don't do it, I'm sure somebody will

    There have been similar posts in the past - some will say some no some yes.. up to you whether you set site up as completely different vertical to the category they have the TM in so absolutely no fear off passing off allegations from the incidental "accidental" type-in traffic that you will attain

    Personally, on principle I say no. There are plenty of legitimate ways to make money from domaining, so why resort to squatting.

    If their lawyers know what they are doing, they will know that they can DRS you for £750 ish, and if they already hold the trademark, they will almost certainly win. That said it's your decision, but if you start "passing off" yourself as them, you could face a damages claim.

    If you do go for it, just remember to save the proceeds for any legal action that might happen.

    If it is the one I think you are talking about, the status of the trademark is only "Examined" - presumably they will get it, but I don't believe they currently hold the trademark. Don't know if that makes any difference.

    Having had the fun of the fair with the trademark bottom inspector.... I say leave it well alone, run to the hills, meditate for 40 days eating only juniper berries and obliterate all memory of such a deed.

    Or you could just buy it and gamble on a nice little earner vs a right good spanking.
