Thread: Anyone recommend a good solicitor who knows about affiliate marketing?

    As per the subject.

    One of our suppliers has sent over a draft licensing agreement which among other things outlines that they want to hold us responsible for any act that an affiliate makes with the threat of cutting us off and getting damages from us if the affiliate does something they don't like.

    I need to find a solicitor who understands affiliate marketing (which is unlikely in Shrewsbury) to look over the draft agreement as there are some points which there is no way we would agree to but others we are not so sure about so need a pro to look at it.

    Any recommendations? or if there is anyone with any experience with this sort of thing that can help let me know.

    Any specialist business solicitor worth there salt should advise you in contractual law. We use Nelson in Derby for all our business agreements and the best advise we had when we first approached them is that all contracts first written are biased to one side.

    And I can certainly say this contract is biased

    I think part of the problem stems from the fact that because we have done so well with our affiliate program they have their own online retail site and want to start up their own program - even though after i advised them on networks they went with one of the worst ones possible.

    So it's a case of they want a big slice of my pie and are trying to put restrictions on us so they can get it.

    The stupid thing is that they will never, ever do as well as we have done ( it will be impossible for them) but they think they can (same old story from something else they tried to do before with us).
