    Hi Phil,

    You have indeed made sense. Firstly I will speak to the account management teams and ensure that during periods of 'house keeping' and account audits that they review creative to make sure it is displayed correctly and in the right sections. In some instances this does come under the control of merchants so further education may be necessary. It won't be a miracle overnight cure but your frustration is valid and we should resolve it over time.

    Secondly we are not initiating these T&C's changes to penalise the vast majority of conscientious affiliates. Whilst I cannot condone across the board use of creative that is not merchant approved via the AW interface, I also fully appreciate why an affiliate would do so; if they feel it benefits the site look (and also the merchant profiled) and creative is not available.

    My first preference would be for you to request the missing creative or confirm approval of your current creative with the network/programme account manager. Before this creates a mad rush, there is no urgency to do this and I mention it only if you want absolute peace of mind.

    This particular clause has existed in prior affiliate T&C's, you will also note that previously it has never been an affiliate issue or concern. Merchants rightly want to feel protected that their brand is not associated with unapproved content and I believe in 99% of cases affiliates understand this reasoning and limit custom images or logos to those taken from the merchant’s actual site. This is less likely to cause any merchant concern, as opposed to using a poor quality logo reproduction or a competitor’s product image which would raise alarm bells.

    In these circumstances I would ask affiliates to use common sense and good judgment. If in doubt seek approval for the copy or only use pre-approved copy.

    Also as a final note, I'm sure it may have been said before; if you have accepted prior T&C's all subsequent amends will include you, it is to the benefit of all affiliates.
