    Have just seen the new T's & C's from Capital One.

    It's a complete joke to think some worthless mutt wearing a second hand hairpiece would of actually sent a bill to Capital One to produce these "legals".

    This especially made me laugh.....

    "5. Publisher shall not register, lodge or supply with or to any internet search engine or like service the terms ‘Capital One’, ‘Capitalone.co.uk’ or any other phrase containing the name ‘Capital One’ (“bid”) unless a licence has been issued by Capital One to do so. Agreeing to these Terms and Conditions does not constitute such licence."

    Why don't merchants like this actually employ people that know what they are talking about instead of law school wanna-be's that simply dig out their old homework books and used pantyhose when trying to write up an agreement.

    Somebody should explain to this Wally that by simply having the text "Capital One" on a web page, that you are supplying this info to search engines each time your site is spidered. And duuuuh...if i don't put some text up how am I going to set up the text link to send you customers...

    I'm surprised and disappointed that CJ with their in-house knowledge don't explain to merchants like these that by putting up T's & C's like these that they are simply hanging up a sign saying "hey, look...I'm a dickhead...and so are the Wally's we employ as legal advisers.

    Anyway...enough of that.

    If anyone from CJ or Capital One reads this, could you please confirm what I need to do to get my Capital One Licence? Do I need to supply a photgraph as well - like when you apply for a driving licence. And do I need to sit a test? If so are there examiners in the village where I live, or do I need to come to London to sit it? Most importantly - will my Capital One Licence come with a A4 size Certificate in a frame that I can hang on my wall?

    Please reply with these answers soon because I am taking the Capital One affiliate marketing program just as seriously as Capital One is .......

    I think it's only fair to warn you that you uttered the phrase " C***** One" several times in your post mate.

    You did not seek prior permission for this and you may be visited by the C***** One death squad who will neutralise the threat to C***** One national security.

    you need to look in the mirror now and utter "sorry I may have offended thee oh mighty C***** One" 7 times or else they will come.

    oooh noo I mentioned C***** One damn... damn where's me mirror.. will now refer to them as " *1" instead ...phew

    From a legal stand point "one capital" is not a registered trademark - however having said that you could be sued for what is called "passing off" where you are causing confusion in the mind of the customer.

    You see C______ O___ could claim to own that capital city could'nt they......

    Well in answer you question, believe it or not, for the UK its my sister. I have a few stories about why they are going to these lengths but unfortunately I dont think I can share them with you.

    I guess you can use "Crapital One" too?

    I think it's clear they're talking about *bidding* on those terms which is fair enough, but it's so badly worded as to be almost incomprehensible.

    Sounds like they hired Lionel Hutz to me.

    Are your stories related to impending legal action on the PPC TM bidding front?

    I dont know about PPC. Although surely it is inevitable that a case will arise at some point with the number of sites using this tactic without promoting the TM they are targeting.

    Lets just say that domains are a very touchy issue. I am sure you get what I mean.
