Has anyone else not been paid from DGM with commissions due from BE Broadband?

It seems rather strange that since BE have gone to Buy.at, DGM won't pay what's owed from months ago.

Apparently DGM are waiting for BE to pay them before they would pay out to the affiliates. Although for the last 3 years or so they have never missed a payment. (apart from a couple of days late)

Hi

I appreciate your concern regarding your payment and i can assure you that we are doing all we can to obtain the payments from BE

As you rightly said we normally very prompt in our affiliate payments, however due to the recent changes with BE we are yet to receive payments from them and therefore are unable to pay any commissions for BE sales until we do. This issue has not occurred in the past due to the fact that payments have been received on time from the merchant.

We are working closely with BE in order to resolve the issue as fast as possible.

Unfortunately still no concrete news on when they will pay us. I am assured that we are making progress with the issue.

Hi George, thank you for your reply.

Unfortunately I have no choice but to be patient, this money is obviously not forthcoming so far.

I have copied a couple of clauses from your T and C's

5.4
Monies shall not be due or payable to the Affiliate in respect of Valid Actions until dgm has received cleared funds in respect thereof from the relevant Advertiser. If an Advertiser fails to pay dgm for any Valid Action then dgm reserves the right not to pay the Affiliate in respect thereof provided that dgm shall treat all other Affiliates within the Performance Network in the same way in relation to that Advertiser.

If dgm has not received payment in cleared funds from an Advertiser within three months of a Valid Action and as a result not paid the Affiliate, then the Affiliate may request that the debt owed to dgm (“the Non-received Payments”) be assigned free of charge to the Affiliate such that the Affiliate may make a claim against the non-paying Advertiser.

Can you confirm when the 3 months period is? Bear in mind your invoice is dated 31st March 2010 and all valid actions were before that point.

I would now like to make a claim against BE Broadband for monies owed.
