In the context of our email marketing activities, we have created a major email database of opt-in partners.
With a file containing more than 14 million email opt-in partners in France, UK, Germany, Italy and Spain, we have become specialists in email addresses of prospects with the exclusively emphasis on performance.
I should like to suggest exchanging part of our email files.
The basic exchange, while complying with a certain number of constraints (legal, technical, ethical and commercial) will make it possible to multiply details of prospects and to do so instantaneously and at minimum cost.
There is no risk of your database becoming overused.
In fact, the overuse of a contact cannot be measured in overall terms but depends on each sender (who has acquired the right to solicit the prospect)
A contact may unsubscribe or no longer react to the solicitations of a sender (Meetic, for example), but continue to regularly open business offers coming from elsewhere.
Knowing that it is IN OUR NAME that we will be routing the database exchange that is coming from the other party, our respective proprietary databases will remain unchanged.
How would such an exchange of databases be performed?
The legal procedures for an exchange transaction performed on a file of email addresses (extracts)
1/ The collection and processing of e-mail addresses of opt-in-partners exchanged as part of an exchange must naturally be entirely compliant with the provisions of the Loi Informatique et Libertés [Data Protection Act] especially with respect to performing the prior obligatory formalities with the CNIL, the legality requirements and absence of unfair
competition in the data-mining, personal information (CNIL note) and taking account of the rights of access for rectification and opposition to becoming a prospect to which they are entitled.
2/ The partners are required to have obtained from the owners of the opt-in partner e-mail addresses their consent to use their email address and to assign usage to a third party and they must be legally competent to enter into an exchange heads of agreement.
3/ Each party undertakes to inform the other Party throughout the period in which the opt-in partner e-mail addresses are available of any request received from an individual whose e-mail address has been the subject of a Contract of application, whereby the latter wishes to object to his/her data being used for prospecting purposes (passing information to third parties).
4/ Before being able to use these email addresses, and in order to comply with the Informatique et Libertés Law of 06/01/1978, each partner must send an updating email to its contacts in order to introduce them to this partnership and enable them, where applicable, to exercise their right of access, rectification and opposition to the information relating thereto. Each partner further undertakes to inform the other party if it receives a subsequent request from a net surfer whereby the latter wishes to oppose his/her data being used for prospecting purposes.
5/ We can make an ftp server link available to you (securitised with a login and password) to which we can upload the list of emails involved.
6/ We will not provide (and will reject) any indirect exchange of databases (i.e. where the email addresses are not owned by the partner but are the result of a previous exchange)
The practicality of an exchange operation of an email file (extracts)
The ratio of exchanges will be “one for one” (Dedoublonne)
Each will have a right of use of the other’s database (we are not the owners of the database)
1/ Signature of an exchange framework agreement
2/ Exchange of invoicing (in order that we may comply with our taxation obligations)
3/ Despatch of respective email databases (via email / ftp / CD)
4/ Mutual despatch of an information email concerning each new database (information from third parties)
