eBay Partner Network and VAT // EC Sales List?

Do affiliate earnings from the eBay Partner Network have to be put down on the VAT EC Sales List?

I was under the impression that they were based in Luxembourgh (LU 21416127) - and whilst "outside the scope" would still need to be included on the EC Sales List

However - today I've downloaded a few invoices from the EPN control panel and I see a US address:

Payment from:
eBay Partner Network
2145 Hamilton Ave
San Jose, CA 95125 USA

Does this mean that all EPN earnings are "outside the scope" and do not go on your VAT return (or EC Sales List)

The invoice combines activity from eBay UK and eBay US on the same sheet, but only has that one San Jose USA address


I rang RO Eye today to ask (they manage the programme) but they did not know the answer.

I thought I'd read in the past on A4U that eBay goes on the EC Sales list - can anyone confirm either way please?

I've spotted that babrees asked a similar question on A4U on 29th Nov 2010 (in 'Affiliate Marketing Lounge' rather than this VAT and Tax forum)


I've been meaning to get an accountant for a long time - and my New Year's resolution is to finally get one sorted. I just spoke with Keith (hrbs) for an initial quote and whilst on the phone I asked him about this. Just in case anyone else was wondering: eBay Partner Network shouldn't be included on the EC Sales List
