    Bit of a numpty question this.

    If a merchant does not allow bidding on it's trademarks you would think that a search would not return any sponsored links, but clearly this is not the case.

    How are some affiliates getting around this?

    wait till the 5th of May.. you'll be able to advertise on what ever trademarks you like (and can afford) !

    Google might allow it, but surely the merchant has the right not to?

    Are some affiliates just taking a chance that they will not be discovered, have their commissions refused and booted off the programme?

    Yes they could be chancer's however they might be member of a closed brand bidding group or it could even be the merchant using the network to track its own brand bidding.

    Never take it as a sign to 'do as you see' you'll end up more than likely getting on the wrong side of the network and the merchant.

    If in doubt contact the merchant yourself and ask them what there stance is on brand bidding.

    Google allows it, but if the merchant stipulated in their terms that there should be no bidding of their trademarked terms, they can just wait till you generate lots of referral leads/sales for them and then terminate your account and refusing your commissions.
