I understand were Kudos is coming from, All cashback/reward sites take risks everyday to ensure they offer the best customer services, but many have the "wait till we get paid" module
But I don't think we would take such a high risk!
It could not be all Zanox's fault though, Maybe the merchant didn't have the 12K and just thought "hey there fraudlent"![]()

Zanox definitely have a lot to answer for here.
If it is approved, it should be paid. Simple!
Zanox - can you show T&C's the affiliate agreed to when signing up to the program?
Personally if I was the head of Zanox I would take it as a learning curve, pay out the £12k I owe and then change the T&Cs to avoid the situation in the future. £12k is a lot of money but rather admit the mistake and payout rather than have a bit of a PR diaster like this.
Its 12K though!
Looking at it, we really need to hear Zanox side of the story.

I have taken legal action and am awaiting advice from my German Lawyer. Legal action was starting months ago btw. I'm not hot air, as somebody suggested.
Unfortunately, taking a company to court has its costs!!
After waiting for a reply from Zanox, which was extremely late coming, they have now accused me of the fraud directly. Apparently because I would have benefited from the fraudulent sales, that makes me directly and personally responsible! I have to say this is a laughable accusation, of which they have zero proof. I WAS NOT responsible for my customers actions, and as such cannot be held accountable, at least not fully.
This new accusation has never been mentioned before. Conveniently, by accusing me of the fraud personally, they have due course to withhold commissions. Obviously further action will be taken by me in this matter.
So it continues....
p.s. I don't agree with abusing Zanox staff. The people I dealt with were, in the most part, helpful. When things started turning sour the relationships did change slightly, but overall I don't have a problem with the UK staff. My problem is with the processes mainly, in that they can decline commissions which have already been approved. This could have been resolved directly, and boy-oh-boy did I try. Posting on this forum was a last resort before taking legal action. I'm very sad that it has got this far.

Yes. Zanox are a German company.
Even if you are based in the UK (like me), when you join you are agreeing to the T&C, which are applicable under German Law, not English.
That shouldn't really make much difference, until you want to take them to court, then ofcourse it will.![]()

Talking generally, the main problem is, UK solicitors are trained and practiced in UK law. This means that they have no clue about German law! It's a totally different system, apparently.
Therefore you have to employ a German Attorney. The best place to find one of these? You got it, Germany!!
Also, there are cost differences too. With the German system, the loser has to cover ALL the legal costs. Makes it quite a commitment when taking somebody to court.
I really hope you get this sorted and get the money back, seems like its going to take a lot of time, cost, and stress to do this.
have to say hearing this whole story would definately make me think twice about promoting something through Zanox! very bad PR for them indeed.
i dont know if any lawyer is here, but because of europe you can "chase" any european company "locally and the decision is 99% applicable europeanwide and i say 99% because i am NOT a lawyer but also i know that in case there are assets of a company "locally' based on a "foreign" european decision you can cease them.

When we set one of our sites up our solicitor stated a test case of a french company that sold products globally was taken to court on the basis that even though they stated 'laws applicable to france' they marketted/tegetted other regions and hence this disclaimer did not exonerate them from local laws to which they targetted.
