Re: Zanox owe me £12k but refuse to pay!!!

QUOTE:Our policy regarding payments to affiliates is in line with many other networks and is based on VALID business transactions which have been CONFIRMED and PAID by our merchants.

This isn't strictly true. Last year, on signing up to Zanox, we were new to their procedures and policies. We mistakenly left the 'auto-confirm' feature switched on in our account. We offer a 60 day MBG, so obviously the 14 day 'auto-confirm' didn't work for us as it leaves us open to fraud (we have since reached an amicable arrangement and are happy with Zanox).

As such £1000 of sales were mistakenly approved via the 'auto-confirm'. After much deliberation and many heated emails we were expected to pay the Zanox invoice (even though 90% of the £1000 was fraudulent).

Zanox informed us "as soon as a transaction is approved by the Merchant we pay the affiliate", we then invoice the merchant thereafter. Strange way to do business we thought, forking out up-front prior to being paid by the Merchant?

To date I have dealt with a few account managers at Zanox, the majority being next to useless. Until recently that is - I now have the pleasure of dealing with their Director of Operations for the UK, Mitun Pandey. A definite asset to the Zanox team, dedicated, professional, punctual and efficient.

If only the rest of the team could follow Mitun's example.

it’s the clients duty to sort the good from the bad in the pending stages, what else is going on during this time.

If there are fraudulent customers then weed them out, if it persists get rid of the affiliate, they clearly got lazy, waited until last minute then approved everything in sight. to then sulk about it when things go wrong is crazy

I think it should be paid if approved

A similar scenario happened with another merchant on the CJ network a few years ago and CJ stance was 'Pay up as you missed the opportunity to rectify it'. IN the end a meaningful discussion took place by all and a compromise was reached to all party satisfaction.

I think you could take this through the English courts (note UK is the wrong word here!) and they would make the decision locally as another pointed out. I did study private international law, and in the recesses of my mind, I remember something about cases being tried which apply the law of the jurisdiction of the contract, but that this can take place in England.

As ever, I await correction, however!

This is really interesting! Its in direct contridiction to what I was told. It seems they are fighting both sides, to their advantage.

For the record, this is still on going. I have run into some obstacles at my end on a personal basis which has held things up. Ill be cracking on with it soon.
